1. Acceptance of Terms Welcome to The Fête (http://thefete.ca), operated under CleanCuff Inc. By accessing our website, creating an account, or using our platform to list or rent items, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.
2. The Platform’s Role The Fête is a peer-to-peer digital marketplace. We provide the software that allows individuals and businesses (“Vendors”) to list event decor, furniture, and related items, and allows individuals (“Renters”) to discover and book those items.
- No Ownership: The Fête does not own, store, inspect, or guarantee the physical condition of any inventory listed on the site.
- Third-Party Transactions: Any rental agreement made is strictly between the Vendor and the Renter. The Fête is not a party to the physical rental contract and cannot be held liable for damages, injuries, or failed deliveries.
3. Vendor Responsibilities & Prohibited Items Vendors are responsible for ensuring their items are safe, accurately described, and available for the dates booked. To maintain the safety and aesthetic of our platform, the following high-liability items are strictly prohibited from being listed:
- Inflatable structures (e.g., bouncy castles, slides)
- Large structural marquees or load-bearing enclosed tents
- Pyrotechnics, sparklers, or open-flame equipment requiring permits
- Firearms, weapons, or hazardous materials
Any prohibited items discovered on the platform will be immediately removed without notice.
4. Renter Responsibilities & Assumption of Risk By booking an item through The Fête, Renters agree to the following:
- “As-Is” Acceptance: You accept the rental items in their current condition upon pickup or delivery.
- Assumption of Risk: You assume all responsibility and inherent risk associated with the loading, transport, setup, use, and teardown of the rented items.
- Damage & Replacement: You agree to treat all rented inventory with care. If an item is damaged, lost, or exceptionally soiled while in your possession, you are liable to the Vendor for the repair or full replacement cost of the item, not just the rental fee.
5. Payments & Cancellations All transactions are processed securely through our third-party payment gateway (Stripe). The Fête retains a service fee for facilitating the transaction. Cancellation policies (e.g., full refund vs. non-refundable deposit) are set by the individual Vendors on their respective listings. Renters must review the Vendor’s specific cancellation policy prior to booking.
6. Limitation of Liability & Hold Harmless To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless The Fête, CleanCuff Inc., its officers, and its employees from any and all claims, damages, liabilities, injuries, or legal fees arising out of or related to your use of the platform, the rental of any items, or your interactions with other users.
7. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein.
